Speeding in TX, from PA


What is the name of your state?What is the name of your state? Got ticket in TX, live in PA

Here's my situation. It was a rainy day after work, last day of the month, an ambulance had just gone by, so I know I slowed down. I admit to going faster than the speed limit usually, and I probably was this time, but I got pulled over for going to 55 in a 40, and I know there was no way I was going that fast. The officer didnt even take my license back to the car, so I am led to believe that he was just trying to fill his quota, and i went by at the right time. Also on the ticket, there's a W in the race box, and im clearly not white. So either he had the ticket partially written before hand, or he doesnt want to make it seem like he's pulling over a bunch of blacks and latinos. Anyway, I've already pled not guilty, and I will be in court next week, and I'm just looking for any suggestions or opinons on what I should do, thanks.

Well, are you black? Latino?

Latino isn't a race, by the way....it's an ethnicity. There are two classifications - White Hispanic and non-white Hispanic, according to most government institutions. So if you happen to be of Hispanic descent, but your race is white**************.....

Anyway, I'm not familiar with Texas law, but how did he write you without using the information on your license? Did he stand there and write it instead of going back to his car? How does that mean anything?

My only advice would be that you will need a stronger defense than the race block and the "he didn't take my license back to his car". Good luck.

I'm actually half black half hispanic, so the race box probably wont help much. But my real defense is that were he was positioned, he had to wait for my car to come up over a hill, and by the time he would have seen me, decided I was speeding, and clocked me, I would have been past him if I was going 55, and he put his lights on right as I got up to him. Is that something that can hold up in court, if i take pictures, and do all the math?

Well, anything's worth a try, right? But what if he was using RADAR? He wouldn't have to see you, decide you were speeding, and then clock you. He could simply be sitting there with the RADAR unit out the window, and the very second your vehicle enters the RADAR field, it displays your speed. So the RADAR displayed your speed before your brain even processed the fact that a cop was there.
