Speeding violation in a tunnelHello, I would like some advice about how I should proceed with my trial for a speding violation. I have a NJ license and license plates, but I was pulled over in Boston, MA in the tunnel by Logan Airport. The P.O. clocked me with a radar as going 66 in a 45. The tunnel in question is I-90, and I had just come out of a turn when I saw the P.O. standing in the middle of the road with his radar gun on his forearm. It was 11 PM and I was picking someone up from the airport. He flagged me over and there was not much chit-chat between us, I dont think I said a word at all. He said "You were going 66 in a 45. License and registration". He didnt ask me whether I was speeding or what my speed was. He seemed agitated. I didnt know I was speeding actually. There was a speed limit sign but I must have missed it, when he pulled me over, the tunnel went into another curve and when I came to a stop on the shoulder I could see there was another speed limit sign up ahead. I had assumed that the Pike would be a 65. There was no traffic pretty much, but every person driving past was waved over. He even pulled over 2 people on his way back to the car with my license and registration. What I was wondering about is: 1) I didnt admit I was speeding - is this substantive? 2) It was a tunnel - is radar/lidar accurate in a tunnel? When he clocked me, I had just come around a turn and was roughly 150 feet from him. He waved me over when I was 50 feet from him. I could at least argue down the speed I was going 3) Im out of state and unfamiliar - not a good excuse huh? What I would really want is just a plea bargain where I go to take a class. If that doesnt work, I wanted to make a argument about it being a tunnel and maybe some inaccuracies and state that I was going 55 or 60 and not 66 just for the difference in points. Thanks for any help |
