Speedy Trial Timeline in PA ??


What is the name of your state? Pennsylvania

Is there a right to a speedy trial in PA for speeding violations? It seems to me I thought it was 45 days from pleading to hearing.

I could find nothing requiring a "speedy trial" in Summary Cases.

You're not being charged with a felony. The right to a speedy trial does not apply.

Wrong!!! The CONSTITUTIONAL right (VI Amendment) to a speedy trial applies in ALL criminal matters, whether felony or misdemeanor.

And as already shown in another thread, you don't know that traffic court IS a criminal charge.... but you are wrong on that also.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Wrong. Speeding is not criminal.

Hey, here's an idea...since you know so much about court and claim to have such close ties...why don't you run a criminal history on someone, eh? See how many speedings show up next to the shoplifiting and burglary charges?

Oh wait...NCIC doesn't maintain speeding tickets...hmm...

Trying to explain legal facts to you is like talking to a rock. You have your head so far up your ass that you can't hear, or see, anything but your own crap.

Well, traffic violations are considered to be criminal offenses b/c technically you got caught breaking the law and you can be tried for it in court. No as for why speeding tickets aren't in NCIC, its b/c you weren't arrested, merely issued a citation. You get put into NCIC for criminial activities if you're wanted (warrant issued for your arrest) or have been arrested. (There are a myriad of other reasons for getting into the NCIC database, check out the link for the full list: [url]http://www.fas.org/irp/agency/doj/fbi/is/ncic.htm[/url])

If you were arrested at the scene of the crime for a serious traffic offense (DUI, vehicular homicide, reckless driving, etc), you will be entered into NCIC. Also, it is possible to enter NCIC on a nonserious traffic violation like a speeding ticket: if the ticket goes unpaid, whether intentionally or accidentally, a bench warrant will be issued for your arrest, and poof, you're in NCIC.

Yeah, you're mostly right.

Minor Traffic (i.e. speeding) isn't punisible by jail, therefore, not a crime.

Even a warrant for minor traffic won't get entered into NCIC...unless is extridiable...nor will it show up on a TYPCIAL criminal history.

Reckless Driving seems to vary greatly from state to state...the post from Michigan stating that there's a possible 90 day jail on it whereas in Wisconsin, it's merely a forfeiture.

Same with OWI. 2nd and subsequent here is a crime, first is not. Some states really hammer it home, here, they don't.

The other examples I would suspect are felonies no matter where you go.
