Question

Statue of Limitation on speeding ticket WV


What is the name of your state? WV
This is really a multi state problem. I used to have an Ohio drivers licence. In 1988 while I had this drivers licence I got a speending ticket I forgot about. I changed states of residency and got a NC licence. Now NC says I can not renew my drivers licence because Ohio has suspended my licence for the traffic ticket in WV. Seems they say I have to pay WV ticket, pay Ohio money for reenstatement then pay NC. What is the statue of limitations on a ticket in WV? Why do I have to pay Ohio and NC? Any advice would be nice.

There generally are no statute of limitations on ticket -- the statute of limitations gives you limits on how long the state can wait to charge you for a crime, not how long they have to adjudicate the matter. When you got the ticket, you were "charged" with a crime or infraction, and at that point, there is no statute of limitations -- the ticket is potentially good forever. Some states may let tickets drop off of their computers after a certain amount of time (not that I am aware of any that do, however), but there is generally no statutory requirement that they do so. You'll almost certainly have to end up paying all of the associated fines in order to get your license back in order.

Hopefully there are no warrants out for you -- those don't expire, either. You may want to hire a lawyer to check everything out for you and get everything cleared up once and for all.

EDIT: Just for completeness' sake, also, if you leave the jurisdiction, any statute of limitations that MAY be running is "tolled" -- in other words, as soon as you left WV, the clock "stopped" and won't start running again until you return to WV. However, there is almost certainly no statute of limitations issue here anyway, just thought I would add this to make the answer complete.

Pay all fines outstanding (get receipt), get your license reinstated in Ohio (get letter from court), then renew. It's as simple as that.

This is the same advice you received at the DMV. Until you follow it you will be unlicensed.
