Steps to Requesting Trial By Written Dec


What is the name of your state (only U.S. law)? California

I wanted to clear up steps to trial by written dec and how to achieve it.

If the time comes for your arraignment, Can you call that day over phone make your plead and request for Trial by Written Dec? Do you have to get your request approved before you can actually do it? When does the money need to be submitted?

When Pulled over for a 22349 or 22356 does the officer just need to prove that you where speeding 1 Mile over the Maxiumum? is Pleading not Guilty to the Charge of the Supposed speed a defence, Even if you know you were doing less, I read on a guy who told that judge that he pleads not guilty to the charge of a High speed and when the judge asked him how fast he was really going he stayed quiet and was found not guilty. Does this seem unreal, even though he was very much able to prove that the clocked speed was 100% off?

Come on SMithy, you've been here long enough. You don't need permission. Get the form off courtinfo.ca.gov and submit it and the bail money before your appearance date.

One mile over the limit is over the limit. That's all that needs to be shown.

"I know I was doing less" won't fly against any cogent statement from the officer as to your speed.

Thanks for the reply, Now which one of my questions is this addressing, I'm not asking for my own cases I want to know this information regardless, and I read that case where he was found not guilty!

P.S. Thankyou for the one mile over the limit, That I was pretty sure of.

I would like to get another reply if anyone would be so kind, Thank you.
