Temporary permit,no licensed driver!


My 18 year old daughter was pulled over for speeding (10 miles over limit). She had passed her drivers exam but had not gone to the BMV (OHIO) to get her license so she still had her temp. She did not have a licensed driver in her car. She was given a court date (yesterday). In the meantime, she went & got her license & had it with her yesterday. The judge (or magistrate?) gave her another court date (3/6/02) & told her she is facing $1000 fine & 6 months in jail and that she should get a lawyer!! I am VERY worried about this & am wondering, how can a lawyer help? My daughter also has priors (all driving related) and is quite honestly a victim of circumstance or bad luck in almost all. She has always been a good kid & I am very worried & unsure what we should do. Any advice would be appreciated! She also previously lost her license & just recently got them back Thanks....

I do not understand how you can say you don't know what to do when the judge told you exactly what to do.

Ok, Home Guru, I see your point I guess what I am asking is what can we expect? Sorry, I'm just a basket case this morning! I also hope it doesn't sound like I'm making excuses for my daughter, I'm just concerned. Jail time is quite an eye-opener. She is going to contact a public defender this morning. The paper the judge gave her stated that she should do that, so I guess we'll go from there *sigh*....

That's horrible. The same stuff happens to me all the time. It is tough when you do not know what to expect. I'm in Mississippi (where they do everything a** backwards), but the judge would have dismissed the whole thing if she'd gotten her license before her court date.
