Did he give you a copy of the amended citation?

It really depends on the laws and rules in your un-named state whether he can do this or not. But, if you are aware of it, there may not be an issue as you were given notice. Perhaps you can consult an attorney who can tell you what recourse you might have on the matter. I suspect, though, you will have to deal with the violation at hand one way or the other.
