Ticket from an accident


What is the name of your state? GA

I received a ticket when I rear ended someone. I admitted to my fault and my insurance company took care of the other party's claim. Now, I am wondering if there is a way for me to get out of this ticket or at least it going in my records since there claim is already taken care of and this is not normal where I get into accidents like these.

What is the exact offense you were cited for? (It should be a numerical code section)

The code on it is 40-6-49. I believe that is it as it does not show very clearly. The ticket is cited for "Following too closely".

Well, please understand that you WERE following too closely - as evidenced by the accident which you freely admitted fault to.


40-6-49.
(a) The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.

I completely understand as it was not right of me. I am going to regrettably pay a penalty for it and I will. All I am wondering whether I can avoid getting this going to my driving history as I have been a goo driver in the past and would not want my record tarnished because of this one incident.

There's no statute that says that if you haven't been caught committing a traffic violation that your first one won't be charged against you or anything like that. All you can do is plead with the DA and hope they offer you some sort of plea bargain. A local attorney could be useful as they know what the courts want to hear.

Side note, please note that insurance companies operate on their own point system separate from the DMV. Even if you somehow get this ticket thrown out and no points are assigned to your license, your insurance company already knows you were at fault and will assign their own points to you, and thus increase your premium.
