A young man I know was over the other evening and he told us a story that we are pretty sure is an infringement on this rights. He was motorcycle riding with two other guys at high speeds, they passed a county officer who turned around to follow. He did not turn on his lights. Two of the guys sped away, but this boy pulled over. He said the law enforcement officer got out of his patrol car and checked out the license, registration and such. It was all legal. The officer went back to his patrol car several times seeming not to know how to proceed. He finally came back and said that he did not know what to charge the guy with so he said, "I am letting you go." The boy left and stopped by several friends houses before he headed home. When he got home the same officer was waiting for him and issued him a ticket for reckless driving. Is this LEGAL?

| | | ? Thanks, I guess. I'm not sure what legal advice to glean from your reply. The boy is not mine. He is a friend of my daughter's, and around 23 years old.
I'm certainly not denying he was guilty of a moving violation, what I am interested to know is if that is the usual way of ticketing someone-letting them go and then hunting them down and writing them a ticket. There was no radar gun to check the speed. My question is simple, is or isn't this legal? If the officer let him go and then changed his mind, could he later issue a ticket?

ok. So it's legal. That seems .....? it doesn't' seem as though it should be.

M | Glad you explained. I didn't know what the heck you were talking about. That is called a signature. It is on all of my posts.
I think this question was asked before, and an officer has 30 days to issue the ticket. Stand by for other responses, but I'm reasearching in the meantime. I don't see a time limit so far.
