| | | | Ticket in Missouri for Arizona drivers license. Missouri - vacationing in Missouri with parents (18 years of age and live at home) parents have a small rental. Have been back and forth from Arizona to Missouri numerous times in last six months. Warned by Missouri Highway Patrol in February must have Missouri license and registration if in state over 30 days. If not a resident and spend half the time in Arizona, am I a legal Missouri resident? Stopped and ticketed for invalid drivers license. No violations, reads Missouri resident with Arizona drivers license.
Thank you.

| | | | The law in Missouri is 30 days as the police told you. However, I fought and won a similar case several years ago only because I could prove residency in California by submitting phone, electric and other 'resident' bills from California and proving to the court that the vacation home I was visiting from time to time was owned by another party.
And this is the only 'out' that you may have. If your parents are residents of Missouri and you are only attending school in Arizona, then you need to have a missouri license because your residence is Missouri.
However, if you live and work in Arizona and only visit your parents a few days or weeks at a time, then you will probably be able to fight this. |

| | | | Reply My parents and I are all residents of Arizona, we have a small rented mobile that we stay in when we are in Missouri. None of us consider this as our primary residence. We have property and a home in Arizona that we have lived in for the past 30 years. (For me, since I was born). Thank you for your reply. I do appreciate all the help I can find. |

| | | | Sorry, but it doesn't matter what 'you' consider your residence. If you stay in the mobile for 30 days or more, legally you are a resident.
The only thing I can tell you at this point is to either pay the fine or hire an attorney because you're fighting a losing battle.
The only way I deal with this now is having two vehicles, one I keep in Tennessee and the other in Arkansas at my home in Bella Vista. That way, I don't get stopped for out of state tags. |

| | | I could not find a definition for a resident. I did find a definition for a non-resident and that they are exempted from having a Missouri license. Can you give me the code section from the ticket?
3) A nonresident who is at least eighteen years of age and who
has in his immediate possession a valid license issued to him
in his home state or country which allows such person to operate
a motor vehicle in the transportation
of persons or property as classified in section 302.015;
14) "Nonresident", every person who is not a resident of this state;
It would appear that you must convince the judge that you are a resident of Arizona. |

| | | | Code Number 302.020 is the code he cited. Thank you for your time in reading my post. If you have any more ideas please by all means post them. Thanks again.

| | | 302.020. 1. Unless otherwise provided for by law, it shall be unlawful for any person, except those expressly exempted by section 302.080, to:
(1) Operate any vehicle upon any highway in this state unless the person has a valid license;
302.080 is the section in my previous post. I have been unable to locate the 30 days in the law but maybe someone else knows where it is.
Thirty days is the law in most states but it has to be an actual relocation of your residence. For example a construction worker in the state temporarily is not considered a resident. |
