ticket for Non-Compliance


What is the name of your state? Ohio This is a really strange story. My daughter had a horrible accident on interstate. She did 4 360 spins and was struck head on when her vehicle landed facing on coming traffic. THANKFULLY, she or no one else was injured. I arrived at the scene with my husband. We consoled her checked on other party, exchanged insurance info. It was then an officer pulled up alongside us yelling out of his window. We didn't understand what he was saying, he then got on his PA and shouted "Who's car is that? Get in it and go". We were all confused and it took us several times to even understand what he was saying. My daughter is still shaken and crying from her accident. The officer then got out of his car and stomped towards us still shouting "who's car is that, get in it and go" We were still confused, what car, this car is wrecked it's not going anywhere. The officer proceeded to jump into my daughter wrecked car and whipped it around in the middle of the interstate to face the correct direction. He then said "now get in it and go". My husband was telling him "we've called a tow truck, this car is wrecked" and I was saying "officer, sir, that car is not safe to drive." The officer just continues to yell and not listen to a word. My husband did as instructed and got into the wrecked car. I was walking to get into the car my husband had driven to the scene in which I was the passenger. I again told the officer when I'd reached my car that the other car was wrecked and not safe to drive. The officer said if I didn't get into my car he was going to arrest me. Of course, I continued getting into my car and feeling like I was in the twilight zone. My husband started driving the wrecked car as the officer instructed and the car darted back and forth across lanes bc the 'tie rod ?' was broken. He could only operate the car at 25mph bc it was "uncontrolable" and unsafe to move any faster. I was following him and saw all of this. Remarkably, the officer is now following us and still shouting on his PA. I couldn't understand what he was saying, however, we took the first exit we came to so we could get this dangerous car off the interstate. The officer exited with us and issued me a citation for "FAILURE TO COMPLY WITH AN OFFICERS DIRECTION"!!!! BTW, the scene back on the interstate had all taken place in a matter of minutes.

Sooo, I have been to court 3 times and suffered attorney fees all bc of a "rogue" officer. I did file an Internal Affair Complaint against the officer. I have just learned he has been found guilty of misconduct during our escapade and he will be disciplined. Finally, the day of my 4th court appearance, the prosecutor dropped the bogus charges me!

FINALLY, my question is this: Can I sue the officer for my attorney fees? My attorney isn't helpful and wasn't during my case. FYI, he was a family friend. Can a "real" attorney sue the officer on my behalf to recoupe my attorney fees?

Me again. I know this is quite a unique situation. Any chance at all getting the officer who was found at fault to reimburse me for the attorney fees I'm out?
