I have a hearing coming up, on my motion for Demurrer (Motion to Dismiss due to defect). I expected the prosecutor to deny my motion (trust me - the judge takes all her Queues from the prosecutor).
My hearing is based on the fact that the original ticket issued for 'running a red light', was never signed by the officer who issued it. The ticket is NOT the complaint. The City does in fact take the ticket and re-issue another complaint based on the ticket info.
Does anyone have information on the status of a ticket which is not counter signed by the issuing officer?
