Ticket on Private Property


What is the name of your state? Alabama

I was driving my motorcycle going well over the speed limit, I pass a cop and he flashes me, I pulled over at a gas station and get a ticket.

Once the cop leaves, someone from the gas station comes up to me and says that you can not get a picket on private property unless the owner gives consent. He said that I should contest the ticket on those grounds and that he and the other employees at the gas station would vouch for me. I have never heard of this and whas wondering if it was legit...

They are absolutely correct. Now, in exchange for that bit of advice and confirmation of the law, I've got some beachfront property in Idaho I'm selling. Interested?

Some states have regulations on requiring consent to sit on private property to monitor the traffic, but I have never heard of any regulation on where they can pull you over.

Okay ... its not like a game of 'tag' where you can shout "Ollie Ollie Oxen Free!" when you drive off the public roadway.

If that were the case, then you could kill someone and then run into a house and the frustrated cops would have to somp their feet until they got a warrant ... and traffic violators would just yield in shopping centers.

what the hell is the point of this forum?

I mean seriously!

I've read numerous threads here and it seems like no one is capable of giving a straight, non-bull**** answer!

A majority of people that start a post are simply asking a simple question or wanting some kind of advice, and it seems like no one who responds is capable of even remotely trying to help, or give a dman. If that is the case, you guys might as well just not say a word.

Okay ... the non-BS answer is the info you got from the yokels at the gas station was wrong.

Is that so different from what has already been said?

My response:

It's because we can't believe that some people would actually ask such a stupid question like yours. Common sense would dictate that a cop wouldn't need "permission" from a property owner to issue a citation on private property for an offense that occurred on a city street.

We get stupid questions all the time. Some are more so than others. Just wait until December 15th. That's when we announce the winner of the Most Stupid Post contest!

Yours actually came very close . . . but, because there was a twinge of seriousness about it, your question didn't quite make the mark. Sorry. Maybe next year.
