Ticket in VA....NOT GUILTYWhat is the name of your state? PA I was traveling in the right lane at the posted speed limit when I noticed an unmarked police car entering the highway from the right median. The unmarked car proceeded into the left lane and continued to drive South on 85 and was well ahead of myself. I was positioned in the right lane and moving at the posted speed limit when I noticed the unmarked car polling off to the left median and put his flashers on. I thought there maybe an accident up ahead and so I put on my brakes as I approached the area that the unmarked car was stopped in. The unmarked car stayed on the left median and since he did not block the highway, I continued on in the right lane. I soon noticed through my rear view mirror that the car behind me was flicking his lights and that the unmarked car was pulling in behind me with his lights on. I quickly pulled over to the right median. Upon the police man approaching my window, he asked if I knew what he had stopped me for and I stated NO. He said that I was going 80 in a 65 and I said “I don't think that I was going that fast”. He stated that I put on my brakes when I pulled up beside him but that I was doing 80 according to his radar. According to my speedometer, I was moving at 55 mph when I passed his car that was positioned in the left median. I at no time was going 80 miles an hour. Once you go above 70 in my Tracker, my whole vehicle starts to shake (guess I need an alignment), so I know when I am going to fast. I want to go to VA and fight this ticket.....what defense should I use? |

Pennsylvania driverYou should just go ahead and pay the ticket. My information is that PA dioes not enter out of state speeding tickets on your record. You need to verify that with the DMV to be sure. There is no defense and all that will happen if you go to court is a possible reduction. |

Since its stated "One is innocent until proven guilty", and the officer will be expected to show proof of such speed, it doesnt hurt to plead not guilty and let the courts decide. Last edited by Tayla; 07-26-2004 at 10:34 PM. |

| From the amount of posts about Virginia, it seems they are out to *sc...* everybody. I am in the same predicament. Was travelling at 70 in 65, & watched the officer casually pull off ahead of me and slowly turn around on the grass to start setting up radar as I went by. He probably saw two females and out of state (Canadian) plates & pulled us over. He said I was going 82 in a 65 & didn't ask me for any explanation - just wrote the ticket. He even put it down as "reckless driving by speed" - not just speeding. Really irks you!!! Especially when I know what speed I was travelling and my speedometer needle has never even seen the 80 mark! Then the scam you have to go through to get VA their money through the court system really bites. Sounds like even a letter and certified copy of our clean driving record won't help without paying for an attorney. |
