totalled car, got willful speed comp. charge


What is the name of your state? N.C.
recently took a curve too wide, while changing lanes, lost control of car, rolled, car was totalled some lady stopped, and started blabbing about street racing, there was a guy that i know there who turned around to check on me, and she said we were racing, the cop that showed up decided to go ahead and ticket us for willful speed competition, no evidence, just a witness any ideas?? thanks in advance.

No evidence?

What about a rolled over totalled car?

What about skidmarks left by said car, indicating excessive speed?

What about an eyewitness?

Sounds like they've got all the evidence they need.

If I were you, I'd be asking the prosecutor about a "deal".

For years NC was having the cops write a ticket on every accident. Some still feel they should.

Go to court and plead not guilty. In some of the NC courts just before they call you, the DA comes over to find out what your story is. In some others they call your case, and you can approach the DA and explain you lost control while changing lanes. He/she might let you off with court costs. If the DA wont agree to throw out or reduce to equipment vioation, Request postponement to get a lawyer. The racing stuff costs people licenses. and the law is vague enough to spell out almost anything.

and that dingbat is not an expert witness. Just a nosy know it all.

Did he give tickets to both of you? I think I would flip if I saw a friend have an accident and I get a ticket for checking him out. Fight BACK

Most of the Cops I've met are pretty good. And the same for the D.A.s
