Question

Ummarked Florida Patrol Car

What is the name of your state? Florida (Orange County, FL)

I read somewhere that there was a Florida statute prohibiting officers in unmarked cars from writing moving violations, does anyone know if this information is correct and/or what the statute is, if correct? Thanks.

**A: why do you ask? Do you have a specific issue? If so, state it as well as the citation number.

My response:

Correct. Also, they're not allowed to carry guns, or stop a bank robbery in progress, either!

Upon further research, the police in unmarked cars are also restricted from using walkie-talkies, cellphones, wireless computers, handcuffs, clubs, mace and must use hand signals when commuicating with other officers in unmarked cars.

Well, I was issued a citation the other night by a state trooper in an unmarked car, in Orange County, FL (not within Orlando city limits, if that matters). I was curious, because I'd heard somewhere that this was illegal, so I have no sources at this time. To those of you who have confirmed that this isn't allowed in the state of Florida, do you have sources that I could possibly site in contesting this citation? Thanks!

Yes, I do. It's call common sense. Before you try to beat this on the advice of 'I head somewhere' think using your brain.

State troopers have state-wide jurisdiction.

Upon what defense do you want to contest this citation, keeping in mind that the only defense to speeding is that you were not speeding?

The 'Peek-a-boo' defense. The officer didn't play fair.

Should have known I'd get flamed for that post....haha, very funny. Now that y'all have beat me on the side of the head with the sarcastic stick, this IS supposed to be a forum for free advice, is it not?

If all anyone wants to do is be cutting and nasty, I will seek other avenues for finding this information. It's not that I CAN'T find it, just that I was hoping someone would be helpful (karma, it does come back around!). Being a programmer/web developer, finding stuff on the internet is second nature to me, but so is finding shorter routes. Thanks for all your help you guys. At least I got a confirmation of my hunch.
