Question

Unfair Freeway Traffic Infraction


What is the name of your state? Washington

I was on the freeway, speed limit is 60, I was going to 62. Cop was the next lane over when pulled up beside him, I was then going 59 mph, he pulled me over. He stated that it looked as if I was going really fast and "since I do not know what speed you were going, I am going to say 70+" but he was in front me in the next lane, he did not pace me nor did he have a radar detector. Second thing, when I was pulling over, I had to go over three of traffic, I happened to stop in the Gore area, because there was an on-ramp, and since I was going to slow to pull, I stop in the triange-stripped area (that is not a lane of traffic) to make sure there were no cars coming onto the freeway. He gave me a ticket for unsafe lane change, I told him I was nervous, and I wanted to make sure that a car going to 60 would not hit us, since I was 40. Can I get this dismissed or reduced?

I'm sorry, I forgot to mention that I do have a mention witness that was in the car with me. Does this help my case at all?

Your "witness" will be considered a hostile witness and this persons testimony may not be allowed. This is especially true if the person is a relative or co-worker.

GDDESS, I am a Washington State Patrol Trooper, since you were stopped on the freeway I think it would be safe to say you were stopped by a Troop. First off, I believe you when you say that you were traveling 59 mph when you got next to the Troop. I was not there but I can almost guarantee, you were traveling faster than the speed limit at a distance before you approached the Troop. He/she observed you in the rear view mirror and performed a pace. This is called reverse pacing. Or if the troop kept his/her speed at the speed limit and you were fastly approaching you were probably written for "speed over legal". This actually happens allot.

As for crossing the gore point, that is what that triangle is called. That is also a violation. Allot of accidents are caused by people crossing those. Remember the Seattle motorcycle Troop that got hit about a year ago because someone was in a hurry and crossed the gore point? Well, it's not safe.

It is your right to contest the infractions and if you believe none of the above happened then maybe you should. Good luck.
