victim of end of the month speeding ticket


What is the name of your state?

I was wondering if the flaw of the citation I received (sec. 3111, sub sec. A - obedience to traffic control devices) sep. 30th of 2004 is fatal enough for me to plea not guilty in court and have good chance to win on my own.

I drive 2002 silver acura hatchback. the citation states my vehicle as 2003 silver honda sedan.

I'm pretty sure he did NOT use a radar gun since my detector did not pick anything up. in item 55 (speed equip. serial no. states - Robic tt07), in item 56 states station equip tested as W 29, and date equip. tested as 9-15-04.
the odd thing about this citation is, in item 53 (miles timed) states as .1000 and in item 54 (secs timed) as 4.99. If this equation states that I did 80.17mph in 55mph zone?? Correct me if I'm wrong but check this out:

.1 miles in 4.99 sec
1 miles = 49.9 secs
1 miles = 60sec/60mph

60
---- = 1.2 ------------> 1.2x60 = 72mph??
49.9

In order for me to do anything close to 80mph, it would have to be .1 miles in 4.5 sec timed!!!! All I did was flow with the traffic and when I slowed down to switch lanes to prevent from cutting a driver off when 3 lanes merged into 2, this unmarked state trooped jumps out of nowhere and pulled me over.
any help or advice would be greatly appreciated!!!

Maybe they'll let you plead to the 72 in a 55.

My understanding is that this is a no point violation. Probably better to just pay it rather than facing the possibiltiy of having it amended to a higher violation.

"Robic" is a specialized speedwatch that converts fps into mph. To my knowledge, PSP doesn't use Robic. Are you sure that it was a Trooper?

The issue of the wrong vehicle listed isn't material. The officer stopped you and issued YOU the citation, so he identified you.

Your math appears to be correct. Even so, it's immaterial as well. 3111a is a common section to write when cutting the driver some slack. You already received a break, since the fine is less than speeding and 3111a carries no points.
