Is this a violation?


What is the name of your state? NC
I was written a ticket today by a state trooper for the following:
on my way to work, I came to a 4 way intersection...where I had the stop sign... in the direction I was going... stopped at the stop sign was a state trooper, no turn signal on,, I assumed he was going to either go straight or make a left turn from his position..I intended to make a right turn, put on my turn signal, pulled to a complete stop at the stop sign to the right of the trooper... there was no traffic coming, but he made no effort to move, so I pulled out onto the highway. He then came after me and ticketed me for illegal passing!!! Afterwards, continuing on my way to work, I noticed at least 5 other instances of the same scenario.. i.e.,, one car stopped where another made a right turn. I have taken the same way to work for 6 years, and go that way several other times during the week, and have seen the exact same thing happen thousands of times, and this is the first time, to my knowledge that anyone has ever been ticketed for that. So what is the law? That if I intend to make a right turn, and there is ample room to go to the right of a vehicle at a stop sign going straight or turning left,, then I am supposed to wait until that person has gone!! How much traffic would be delayed every day with this?? I feel strongly that I have done nothing wrong.. I had a clean driving record prior to this, and was obeying all traffice laws or so I thought. I feel that I have been wrongly ticketed

If there is no designated right turn lane, then it is a violation, regardless of what you "THINK".

All your other reasonings and ruminations are irrelevant

Question

I was reacently in a similar situation. I was behind a vehicle coming up to a stop light in the city limits with a speed limit of 30 MPH. There were no, no right trun sign posted. The light was red. The vehicle in front of me had no turn signal on & was to the left side of the lane. There was no specified right turn lane. (Note: The street was wide enough to have a seperate turn lane, there was angle parking spaces on the right side of the street.) I was at least 5 car lengths behind the vehicle. I was turning right & had my right turn signal on. I pulled up behind the vehicle & saw it was not truning, since no signal was on & it was to the left side of wide roadway. I proceeded to turn right. Just after I had pulled to the right side of the vehicle & stopped to make sure no traffic was coming from the left, the driver then turned right & ran into the front left quarter of my car.
The other driver violated 2 vehicle codes: 1st no turn signle & 2nd if he was intending to make a right hand turn, vehicle was not over as close to the right side of the roadway as he should have been.
The other driver gave no indication of making a right hand turn.
What are my options?

Technically is this passing or is it just making a right hand turn?
It just does not make sense, the law allows right turns on red. But now you are saying you can not turn, when someone else is going straight?
Doesn't the Law allow truns as long as there is enough room on the roadway to safely make the turn? How long would the traffic lines be at the stop sings/lights.
People need to realize there are others on the roadways. It is your responsiablity to signal your intensions.

A: If there was no turn lane you were passing on the right, which is illegle in any state.

A: The law allows in some states for right hand turns if you can safely make them, but you can not pass other cars on the right to make the turn, example a one lane street with cars stopped in front of you. even if the street is wide enough for you to pass on the right to get to the intersection.

People need to realize there are others on the roadways. It is your responsiablity to signal your intensions.
A: While I agree. This is not a perfect world, and some people do not signal or may have a burnt out turn signal bulb and not know it.
