Is it worth appealing the ruling? (PA)


I'm in Pennsylvania. This morning I contested a ticket and got the fine reduced. They also said I won't get any points on my license.

But the officer who ticketed me was not there. At the time I didn't think about it much, since the judge proceeded with the trial. But later on someone pointed out to me that the 6th amendment gives me the right to cross-examine any witness against me.

Is it worth appealing this? Could an appeal result in a re-trial, and if so could I end up worse off?

If the officer wasn't there, there was no testimony to cross examine.
If you admitted some lesser offense in the process, then your own testimony condemned you.

If your argument had been that you didn't do it, the state would have to have had some testimony (from the officer presumably) that you did. In the absence of the officer, the case would have either been dismissed or continued.
