Yikes!


What is the name of your state (only U.S. law)? California
Ok, so I was on vacation in Oregon and was issued a speeding citation. Once I came home I realized I didnt want to deal with fighting the ticket so I made payment arrangements over the phone with the court. The problem is that I recently received a letter from the DMV, informing me that my driving privilege is now going to be suspended because I have exceeded the point limits, and also I am on informal probation. My question is: Can I still ask for traffic school even though I already made my first payment to the court for the citation. By the way, I never actually plead guilty to the violation ( in case that makes a difference), but I suppose it was assumed since I agreed to pay. Any input will be greatly appreciated! What I'm hoping for is to be able to take traffic school and get this taken off my driving record.

Yeah paying the fine is an indirect way of accepting guilt. Not sure how you can ask for traffic school now but you also have the option of requesting a hearing with the DMV regarding your pending suspension.
If this is your 1st suspension you might be able to convince the hearing officer to extend the probationary period on your license instead of probation + suspension.
Keep in mind that you have a limited period of time from the date of the Notice & Order of Suspension during which you can request a hearing.

Whether or not you can take traffic school to alleviate the damages set by the court is up to the court, and as such, you are not likely to find an accurate answer here. Ask the court!
