creating music publishing LLC in delaware

What is the name of your state (only U.S. law)? Delaware.

hi,
I'm a non US resident music professional and I intend to create a music publishing LLC in Delaware, for the purpose of selling and licensing my own music in the US and abroad. I have worked and paid taxes in the US for two decades, and as such I do have a SSN. This LLC will, at first, consist of only me.
I have two related questions: Am I considered a US person for federal tax purposes?
Do I need to apply for a EIN by filling out a W8 form, or can I use my personal SSN?

Thank you in advance. I appreciate any help you can provide. What is the name of your state (only U.S. law)?

Hi,

Not trying to hijack this post, but I'm also interested in this matter.

My case would be an internet-based business (hosting).

This would be my first time doing any sort of business in the US, so I have nothing to start with (legal documents for this matter).

Anyone ?

Thanks in advance

The answer for both questions is that if you don't know and you aren't physically in the state you wish to incorporate in, you need to talk to a lawyer there. Since Delaware has preferential treatment for corporations there is a whole lot of firms there that specialize in setting up corporations for out-of-state clients.
