Royalty payment for this copyrighted music?

What is the name of your state (only U.S. law)? New York; let's worry only about the U.S. for now.

A composer has written and copyrighted 20 minutes of orchestral and vocal music to be played by a professional symphony orchestra. There will be two performances in front of a paying audience numbering 1,000 persons each concert, paying an average of $40 per ticket.

What is the royalty payment due the composer?

What ever is negotiated between the composer and whoever is putting on the concert. There is no statutory required rate here. If the composer has signed on with a PRO (like ASCAP, etc...) they have their own way of computing the rates.

The composer is a member of ASCAP ...

though a fairly freshly-minted one. Does anyone know the nominal ASCAP rate for the scenario described in the first post?

When you contacted ASCAP, what did they say?
