On 7/14/00 I had a load of stone delivered paid by check and found out later that day that it was junk (when my husband got home) I promptly stopped payment on the check and called the company to let them know that I had done so and request they replace the bad stone with the correct stone as ordered. This was over a month ago and the company says they intend to do that but keeps saying they can't come yet the job is a wash to them they are loosing money to come back and switch the stone and continue to hold us up. What can we do?

My response:

It's time to order from a competitor. You need to mitigate your damages; that is, you can't wait indefinitely to finish your project because the first vendor refuses to pick up, and exchange, the stones.
