Hi,

I'm looking to start up a business that offers a free web service to users. I just found out there is a business already offering my service...only they charge a monthly fee to to be able to use the service. Is it still OK to start my business? Again, I'm not selling anything. I earn revenue through ad placement on the site.

Can I still form the business and not get sued?

Certainly, unless they have a patent on the business process but it seems unlikely. There are already a ton of ad-supported free web hosting sites out there and even more for a fee ones. If you only found one competitor you're not looking very hard.
