I loaned someone over the last five years the sume of $45K. This was to be paid back monthly. I received a $23K payment about 6 months ago. I haven't rec'd a monthly payment in 12 months. I have the agreement in writing. What should I do? Should I attempt to attach this person's house (lien) to secure the loan. She knows she owes it and says she's going to pay it, but...She recently took a second mortgage on the house and was able to pay me the $23K. I'm not sure if she may try to "sell" the house to her brother so as to avoid having any property, etc. Her car is paid for and she doesn't have any other collateral. Help!
