Doctor suing us

We had a child on 1/28/00. The doctor added $1,700 in last minute fees (we don't contest) Our insurance companies changed on 1/1/00. New company only pays 70%. Making us liable for $792.00. Old company doesn't pay. When we found out it was our obligation we made four $50.00 payments (8/1 8/12, 9/1 &9/17) on 9/27 they served us with papers suing us for the remainder $592. No notices were sent to us of intent to sue, nothing but normal monthly billings. Now they claim we are responsible for legal fees and court costs. We have went ahead and paid the entire $572.00 to avoid going to court. Are we responsible for these fees? what should we do?

You would not be liable for their legal fees unless you signed an agreement agreeing to pay them but if someone sues you, you would be liable for filing fees and court costs according to your state's law unless you win. And paying them does not end their right to sue unless it is made clear that as part of a settlement the amount you pay is in full satisfaction!
