Donations


What is the name of your state (only U.S. law)? Michigan
I am a manicurist and would like to go to homes to do nail services. I can not do this and set a fee according to mi law. Can I do these services for a suggested donation. If so how should I word it.

HG, manicurists are covered under Act 229, Article 12, of Michigan's Occupational code. Manicurists Qualifications are outlined in Chapter 339, section 1209.

If you are a licensed manicurist, you are not allowed to practice outside a licensed facility, although there are a few exceptions. If you have contracted with, or are employed by, a nursing facility, home care facility, et al, then you are allowed to practice in homes or nursing facilities as per your contract. Or if there is some sort of special event, you may be permitted to give manicures at such an event.

In Michigan, it is less about the pay you receive (and how you receive it) than it is about the health and safety of your clients. There are health worries when one is allowed to practice outside a licensed facility (no check on infectious or contagious diseases you may spread, for instance) and liability concerns. Your "donation payment plan" does not get around the fact that it is the conduct, itself, that is prohibited, not how you are paid.

If you are interested in giving at-home nail care, you may want to contact a nursing facility or health care service, and contract with them to give nail services to their home-bound patients.

You can check out the prohibited conduct and the penalties involved with such conduct (section 339.1217 of Michigan's Occupational Code).
