eBay overseas rip-off??

I recently bid on an item on eBay which cost me over $4000. The seller was in Europe. I sent the cheque and the item was sent (it was sent because I got confirmation) but was stolen en route. Now the seller is saying that he won't refund my money because I only paid half toward the cost of postage and that he paid the insurance, which has been paid to him.
Anybody any idea if I can sue?
Is it really difficult because the guy lives in Europe?
I'd appreciate any advice because I don't want to lose $4000+

Of course there was NO insurance on it right?

How much would that have cost? mot much...

Where is the tracking #, and where did it "get lost"

Did the bidder have a good amount of positive feedback?

Well if he has your money and insurance money then I think Negative feed back is appropirate,

as well as contact ebay's fraud dept.
