Hello Group-

I am hoping you can shed a bit of light or direct me to an online
resource which may help me with this situation.

That contract my company has with a model who appears on product
packaging is now expired, so we cannot use her image any longer.

* Are we required to pull the existing product from the retail and
re-package it so it does not include her image?

* Can we still use product packaging which was printed in the first
batch, prior to the expiration of the contract?

Without reading the exact contract and the phrasiology used in licensing the image the only answer we could give you are approximations.

That being said, most model reprentation contracts follow the same line which would result in these answers.

NO.

* Can we still use product packaging which was printed in the first
batch, prior to the expiration of the contract?

Yes, depending on the exact phrasing of the contract.

The reason I say this is that many contracts include the phrase "...image to be used on xxxx product for the calendar year xxxx..." or some other limiting language.

It's best to pay a few hundred now to have an attorney review your contract. Even if it doesn't get you into trouble now, an attorney may be able to help draft a more comprehensive contract for future use.

AND NEXT TIME, DO NOT DELETE THE STATE!!!
