To determine what permits and licenses are required for your Michigan business, go to www.michigan.gov/mitaps.

You must also check with the county, city, township or village clerk to see if there are any local licenses or permits or registration required. For any business involving nudity, there will be.

There are several laws, acts and ordinances that you must be aware of when operating an "adult" business in Michigan. These include, but are not limited to:

Under the Michigan Penal Code, sections 750.145(c)(1)(j) Child Sexually Abusive Activity; 750.167(1)(I) Disorderly Person; and 750.335a(1)(2) Indecent Exposure.

Under the Township Ordinances Act, Act 246 of 1945, section 41.181 Adoption of Ordinances by Township Boards Section (1)(i) licensing of businesses and (4) public nudity defined.

Under the General Law Village Act, Act 3 of 1895, section 67.1 General Powers of Council, (1)(aa) to regulate or prohibit public nudity.

Under the Home Rule City Act, Act 279 of 1909, section 117.4 Permissible Charter Provisions, each city may (e) regulate or prohibit public nudity; section 117.5h Regulation of public nudity and public nudity defined.

Public nudity is defined as "knowingly or intentionally displaying in a public place or for payment or promise of payment by any person including but not limited to, payment or promise of payment of an admission fee, any individual's genitals or anus with less than a fully opaque covering, or a female individual's breast with less than a fully opaque covering of the nipple and areola. A mother breastfeeding her baby does not under any circumstance constitute nudity irrespective of whether or not the nipple is covered during or incidental to the feeding." (the bolding is mine)

For an interesting look at one of the more detailed ordinances regarding sexually oriented businesses, you may want to Google "Township of Negaunee Sexually Oriented Business Ordinance." The ordinance is 24 pages long.

Some "anti-nudity" ordinances in Michigan have been found unconstitutional due to their particular wording or vagueness, by the way, so if you question any ordinance in your area, have an attorney review it.

I also strongly recommend that you sit down with a business attorney in your area and discuss your business proposal in depth, as more than just permits and licenses are required to run a legally safe business. The attorney can advise you on your liability insurance needs, taxes, etc. Your particular business idea carries with it added legal risks, so an attorney's advice and direction should prove invaluable.
