There is a service company with a similar name in the city which my company is based. That company filed a d/b/a business almost a year before mine was incorporated by the Secretary of State of TX. We are both in the same county.

I had no knowledge of the other companies existence as they did no advertising.
I used a local law firm to file my articles of incorporation.

A cease and desist letter has be issued to the other company and they have responed with the same.

Who has the right to use the name, and does it matter where my company's main office is? Do I have to give up the name. I have been in business for approx 3 years.
