My wife and I have a lease agreement with an LLC we have just been notified was dissolved in March. The LLC leases our home, and then subleases it to another party. Our contract with them ends at the end of July. Can they legally dissolve with the contract in effect, leaving us high and dry?

When you entered into this lease did you get any kind of personal guarantee from the partners in the LLC? That would be a standard part of any agreement when dealing with any small business.

But since the home is already subleased to another party, can you get that other party to assume the lease or sign a new lease?

Have you been paid through June by the LLC? If not, then you should look into suing the partners of the LLC for the March - June rent. By dissolving the partnership in March and not telling you until mid-june, they are making themselves liable for the rent in the intervening months.

We did not get a personal guarantee from the partners. We were referred to this company by our builder when we purchased our new home. It was part of the builders lease option program.

The home is subleased and we've been in discussions with the subtenants regarding a new lease. They are willing to do that, but we need the LLC to terminate the current lease they have with them.

We received a letter from an attorney notifying us of the dissolution of the LLC, and it included the June rent. The attorney also stated that he was helping close out any obligations the LLC has, and said that the June rent was the final rent to pay. The problem is that they are forgetting the contract ends at the end of July, thus we are entitled to one more months' rent.
