What is the name of your state? Massachusetts

Hi,

Myself and one other person is in the process of starting a business.
We are not sure if we should form a S Corporation or a LLC?

The business will consist of subscription based internet sites. Each web-site will showcase a model. We want to offer the model the sum of 33% of overall Net sales from membership subscriptions. These websites are not pornographic and there is no nudity. We would like to offer the model a contract agreement for the web-site. Is it possible the model can be hired as a contractor and not an employee? We are wondering because the model will be getting paid indefinitely as long as the site is up.

Also, after reading some articles, we are not sure the laws around doing business in other states over the internet. Would this concern our business?

Thanks,
-Christopher
