Florida.

Ok, are there licencing or franchise restrictions on say selling food products from other franchises? For example, if I own a local convenience store and want to buy something like Chick-fil-a chicken sandwiches and refridgerate them and sell them on Sunday when they are closed, is that illegal?

Thanks

Your local health department would be the one that would shut down your plan. And the restaurant could prevent you from reselling their products too. You could cause liability issues for the restaurant that they can't control. If someone dies from eating one of their sandwiches that you sold, they could be held liable. Then they would come down on you like a ton of bricks.

The question was about legality, is it illegal? Not will it pass local health code. For the purpose of my question let's assume it will pass all local health codes. Is there any copyright or trademark type issue that goes along with a brand name food product?

The idea is the same as say Krispy Kreem donuts only with other food products. Hope that spells it out more clearly.

Your question is not a legal question, it deals with company policies. Any vendor can sell any product as long as they meat state and local guidelines. Using Krispy Kreme for an example like you did, resellers are licensed by KK to sell their product away from established retail locations. KK has come down hard in my area on some folks that have attempted to sell their donuts without their permission. If you want a truly factual answer, ask your question to the legal department of the food vendor that makes the product you want to sell.
