Hi there,

I'm about to start a adult webcam business and it's not legal to do so in my country(singapore) so i'm thinking of running this online business in some other country legally...

1.So what is it that i need to do to run this business legally in another country and most importantly do i even need to register this business in another country(like nevada?) and since this is going to be an online business, it's not like it has a physical address in a country or state.

2.Is incorporating a US LLC company a good idea for this business or a offshore company like belize,panama etc is better?

3.What legal documents will i need to protect myself from lawsuits or litigations?

4.does this laws apply for businesses incorporated in the US or all over the world:

Privacy policy
DMCA
Terms of use
Kids protection
18 U.S.C 2257 record keeping

5.Can i form a company in bvi,cyprus,panama, belize for example and start a adult webcam business ? My main source of traffic/business will be coming from the USA and i'll also need a merchant and bank account for accepting and paying payments.

Are you going to be living in the great nation of Nevada when you do this? Or do you intend to reside in Singapore and be the first person in the world to try and run an illegal operation by using a different location on paper?

Please go see a local lawyer to discuss this idea. None of us are too familiar with Singapore although I recall it is not the sort of place I would care to break the law!

You are going to require far more help than a legal forum such as this one can offer you.

There are many many many laws in the U.S. that an adult webcam business must adhere to if it hopes to operate legally. Privacy policies differ between countries. The DMCA is a U.S. Act only. Terms of use will differ depending on needs. "Kids protection" laws are enforced worldwide, even though the laws themselves differ from country to country - and violations of these laws are harsh. Record keeping is an important part of any U.S.-based adult webcam business.

You will need to consult with an international law attorney in your area. You need individual assistance that cannot be offered here.

You'll need a registered agent in Nevada to form an LLC or Corporation there. There are license and filing fees due.
Depending on where your "employees" are working, there are other requirements.

Note having a US presence will allow you to be sued or indicted here by US entites/government which would otherwise be very difficult if you were a completely off-shore outfit.

Is there some reason you want to do this?

No i'll be in singapore... and i'm trying to find out how i could do this legally not illegally. I have talked to a lawyer from the US and from what he had told me, it's legal to form a company in nevada and operate outside from US. But my concern is if i'm going to be pushing the buttons from being in singapore, will i be breaking the singapore law... and i am about to consult a local lawyer regarding this tomorrow... i want to make sure i do not break any laws

Yes i want to do this legally so i was thinking of starting a LLC in nevada , since they also have some privacy policy, no taxes for personal and corporate etc... But than again i also think i could set a company in other countries like belize, panama etc and if i do so.. will i need to still have those dmca, kids protection, 18 U.S.C 2257 record keeping etc legally documented?

Hi yes, i am aware of the registered agent and business license fees etc. I'm guessing most of my "employees" will be from the US. And you are right, having presence is US will only allow me to be sued in the US and by going off shore would protect me more .And this is where i start to wonder, since i will be a online business with no physical address to sue.. how will anyone even sue my business ? And also i am thinking why register in a country if i am not going to have any physical address in that country? I just do not get it... The only reason i can think of for forming a company is so that i could open up a corporate bank account to both send and receive payments...

Just a guess here, FlyingRon, but I am thinking money might have something to do with it. :D

You will be taking the first best step in ensuring your website business does not violate any laws by speaking with a lawyer in your area tomorrow and going over your business plans.

Thank you there is so much to think and plan before i proceed making sure i am not breaking any laws in any country. Still have alot to research and learn.

You can collect money from US people without a corporation / LLC here. The law only bans transfers for gambling.
Oh ok but by forming a LLC , in case of a lawsuit i will be protect right against not having a LLC/corporation? i'm starting to lean towards EU countries to form a company now if it's not necessary to form one in the US. just that the 18 U.S.C 2257 record keeping seems to be a federal law by the US and i'm wondering if it'll still apply if i form one in EU jurisdictions.

The U.S. requires that careful records are kept with proof of ages, and many other countries have similar requirements.

Even when not required under a country's laws, the legitimate adult website owner will want to keep accurate records to show that those whose images appear on the site, and those who access the site, are not minors. These records can keep a website from being prosecuted on child pornography charges. No corporate structure will protect you if you are creating or distributing, or facilitating the creation or distribution of, child pornography.

Again, you need to go over all of the laws and requirements of your proposed website business with an attorney in your area.
