What is the name of your state (only U.S. law)? NC

Hi everyone - I have a few questions for the community.

I am currently separated from my spouse and want to start a business. It will be a software company. I would obviously like to protect this company in a divorce scenario. What proactive steps should I take (if any) while launching this thing? Is there risk in using family-owned assets, like computers? Is there any added safety in incorporation? I am physically separated from my wife but have not filed for divorce yet.

Thanks!
