Two members of our firm were served with subpoena for deposition deuces tecum by the husband and wife (two drs) who are in the process of a divorce. Their lawyers are demanding that we appear, submit and discuss some minor repairs proposals for their joint residence. We didn't do any work or were paid anything for the proposals. We are busy people with clients that are paying for work to be completed. They said we are not entitled to any reimbursement and their lawyers have been somewhat nasty and hostile toward us. I explained to them, we are not part of the suit don't really know why they have included as part of this mess. Since our income is based on billable hours, can we demand a expert witness fee for appearance since we are being financially harmed for in order for to attend this depositon? To make matters worse, one of the members used to be my personal doctor. What recourse do we have without spending a bunch of money of getting our legal staff involved? |
