predescessor signed 2yr svc for T-1 line, AT&T activated circuit 12/3/99, being billed $1400/mo, have not paid due to dispute that their auth.agent didn't complete configuration & installation b-4 we can even use the T-1 line.
due to credit check agent wanted 100% cash upfront changing orig. agreement with agent of 10% down, 40% at start and 50% at completion. we don't know why they refuse us credit. since feb00 agent resigned.
at&t sales suppose to provide another agent, they haven't. to this day, sales person unresponsive. we want out of contract but there are term. fees. trying to escalate with higher level mgmt.
trying to argue at&t failed in providing complete svc besides just activating circuit in Part I of contract, (like having new agent complete install, then activate internet svc with IP addresses and email capability which is in Part II of contract).
with orig. agent named on part II of contract, if they failed would think at&t have to give new contract with new agent otherwise makes contract void. at&t says they delivered circuit, done deal - stuck with contract. at&t says they are not responsible for performance of agent.
do we have chance to fight? sidenote, pricing is not competitive, others can offer same for $400-600/mo. so we have incentive to fight.
