We were going to purchase a piece of equipment and then changed our minds. The company inturn sent the piece of equipment. We called them 4 times and wanted to have it picked up. The company told us we purchased the equipment and they won't pick anything that doesn't belong to them. It has been over 15 months and we still have the equipment. What are the legal ramifications of the situation? We are in South Dakota.

They have a claim against you and while they have not sued yet, they probably have a while to do it.

On what grounds can they sue us? We signed nothing, never gave them any money, never accepted shipment of the equipment (it was simply left at our door) and on top of all that have contacted them to pick up their equipment many times!
