I am the current owner of a 1999 Ford Explorer and with the recent spotlight on the design and tires I am concerned about the safety of my family and friends while driving it. I have tried to trade it in but no one wants it. I am a paralegal and an attorney friend of mine told me to review my contract (I am on a red carpet purchase) and see if there is a clause that can allow me to rescind if there is a defect in the design. Could you please let me know if there is such a thing and, if so, how do I go about pursuing this? I want to get out of this vehicle before I or someone I love becomes the next casualty.

It is EXTREMELY unlikely that you can get out of this purchase.

If your chief 'design fault' complaint is the tires, that would not be covered under the Ford design clause, if there were one. It is an easily remedied problem... buy new tires. You might not get reimbursed by Firestone (if they are Firestone tires), but you will be safe.

Now, as the 'future' value of the trade-in, I can see where someone will consider litigation against Ford or Firestone for a perceived loss of value due to the publicity of the tire problem... but even that would be unlikely of success. Remember all those people who owned Pinto's, Fiero's, Yugo's and even Corvair's.

Oh, and get a new attorney friend....
