Greetings from the lovely state of MinneSNOWta!

We are an owner/operator that was leased into another trucking company. Due to mismanagement of the company and several other issues, we left the company and obtained our own authority. We were paid 90% percent of the freight plus any permits and other costs related.

Now the owner of the company is refusing to pay us for loads we hauled, currently amounting to about $8,000, because she said "the money is company money and she doesn't have to pay us until she feels like it."

Normal procedure is to be paid by her the same day the factories and dealers pay her. We have caught her holding our money for weeks upto a month or more, and not paying until we say something about it, then the money magically "comes in the next day."

We have called the factories and dealers in question and they have given us dates and check numbers relating to the freight bills being paid for weeks.

How long can she legally sit on our money?

We pay for all costs incurred ... fuel ... permits ... etc.

Also she left for vacation on the 5th ... for ten days ... took money out of our proceeds for our truck insurance that is due on the 16th ... as of today the 25th ... the truck insurance payment has not been received by the insurance company. We basically financed her trip to Florida.

What is the best legal way to handle this?
