My husband and I are seperated. We filed jointly for 2007. He claimed my youngest daughter (previous marriage) on our taxes, without asking me. My first husband claimed her as well. I told my husband that we had to amend the tax return due to this problem. He said he would have nothing to do with it. I informed my lawyer that he was unwilling to help with the cost to amend our taxes and that I needed to file the change quickly due to my first husbands filing. I never said that I didn't want half of the amount paid for by my husband, just that it needed to be done quickly and so I paid it. NOW my lawyer says that unless my husband stated in writing that he would pay me back half, I can't hold him to it.
Is there truth to this, or is it by law both of our responsibility to pay the IRS what is due? Why am I now solely responsible? My lawyer has said that I need toi forget about it, get on with my life and not make an issue out of it, and that I have no grounds for an argument. He has also filed for bankruptcy. Does this change anything?
