What is the name of your state? NY

My unmarried friend w/no dependants gets paid cash for going on tour with an entertainer/friend. He said that he did not receive a W-2 or a Form 1099 so how can he file his taxes? Is he considered an 'independent contractor'?What expenses can he deduct that are ordinary and acceptable to the IRS? If his expenses are not greater than the standard deduction, he should use Form 1040EZ, correct? He has to complete a tax return for 2003 and 2004 (no tax return was done for 2003 yet).

He wants to resolve the past tax return a.s.a.p. and also, should he pay quaterly for federal tax, social security and medicade?

He should find another employer.

He is probably not an independent contractor, unless he manages several entertainers, sets his own hours, and is responsible for purchasing and maintaining his own supplies and equipment.

As an employee, he should be receiving a W-2. Since he doesn't have one, he should attempt to get one from the entertainer.

If he is unable to do that, he should fill out a "substitute W-2" form, and also a form 4137, and substitute the word "wages" for "tips". That way he can pay his half of social security and medicare taxes.

Of course when the IRS gets his return, they will go looking for the entertainer, and take a keen interest in the tax filings of said entertainer, at which point your friend will lose his job.

He should take all info on income & expenses to a tax pro with 2106 & schedule C experience. The tax pro will determine whether he's an IC or employee & help him determine if he gets to claim any travel expenses & where to claim them.
