Michigan - Received lump-sum SS payment, are the legal fees ( which were deducted) excludable from my taxable income (form 1040, line 21) as opposed to being a Miscellaneous deduction subject to 2% threshhold of AGI (itemized deduction)? US Court of Appeals for Sixth Circuit (includes Michigan) has ruled in some settlements that the attorney fee portion is excudable from taxable income.

Why don't you say what happened? I can't understand your point at all. Sometimes they are deductible and sometimes they are not. Where you deduct them depends on the facts. What are your facts?
