Bought a house in joint tenancy with right of survivorship with boyfriendWhat is the name of your state? Ohio I purchased a home with my boyfriend in June 2002, in joint tenancy with right of survivorship ( thought we were going to get Married). We sold both homes and purchase one together. He put the money down (because he could afford it and has a very good job). He put my name on the deed himself, and my name is also on the Mortgage. What rights do I have since I put no money down, and vertually have none, and do not make alot of money. We are not getting along and I am sick of him threatning to throw me out. What rights do I have? |

| You are an owner of the house. He cannot throw you out. End of story. You own 1/2 the house until you both agree to sell the place. Either of you can force the issue by asking the court for a partition by sale. A better solution would be for you 2 to work out an agreement where he refinances in his name only & pays you some amount of money for your half of the house.

| The court orders both parties to sell the house. Anyone can buy it (including 1 of the current owners). After the costs of sale, if there's any money left over, the court looks at how much each person contributed toward the house & household expenses, then divides the money "equitably". Usually, because it's court-ordered, a partition sale does not command top dollar.
