    California / Nevada state income tax question

    What is the name of your state (only U.S. law)? California and Nevada

    I have a tax question. I work for an airline based out of Las Vegas, NV. I have a residence in California and rent a room from a friend in Las Vegas. I work in Las Vegas 4 days a week and fly/commute home on weekends to California. I have a car I keep in Las Vegas that is registered in California. I am married and my wife works and lives in California.
    My question is : Do I have to pay California state income tax for a job I have in Nevada? Technically I am in Nevada more than I am in California. I can show rent receipts to document my time in Nevada. Can I also write off any travel expenses to/from California/Nevada?What is the name of your state (only U.S. law)?

    Residency is a facts and circumstances test. I'd say you are a residend of CA. But since the answer depends on all the facts you can't tell without going through all the facts.

    Your travel expenses are not deductible from your description.

    If you have a car registered in CA, CA is going to be looking for an income tax return from you.

    Unless you sell your house and move to Nevada, California is going to rule that you are a resident.

    Your income originates in Nevada, but your "domicile" is in California. Your ties are closer to California than Nevada. Your home, your wife, and your vehicle are tied to California.

    If you neglect to include your income on your California return, you will have a fight on your hands. The fact that you refer to it as "going home" on the weekends, indicates the truth of the matter, and CA will see it that way also.
