Can Tax Preparer Refuse To Return Records


What is the name of your state? MISSISSIPPI

Tax preparer was incompetent, rude, would not answer my questions. I asked for my paper work back (W2's, college info, expense record. MY PERSONAL PROPERTY, paper work I gave to her to file my taxes). Did not want her to file my taxes. I feel she was very unprofessional. She called me names, told me to get out of her office, she was not giving me anythinmg back. Etc. Isn't the papers/records considered personal property? Can she be charged with theft? Her business Mary's Tax Service. How can I get my records back?

Report her to the cops for stealing.

Tell her that unless she returns your records to you that you will be reporting her to the IRS. Then if she doesn't return them, REPORT her.

tax preparer won't return clients paper work


THANKS you guys... It was my belief that she could not legally do this, but since she did, and still refuses after certified letter sent to her requesting return of property and informing her of BBB informed...her response was a letter sent to me stating that she has been in business bla blal years and just because I wanted more refund I don't want to pay her for services rendered....and she informed me on phone "I have attorney.." then she hung up on me.

Just FYI...I am recently separated, 2 year old. She informed me that I couldn't claim EIC being separated...that I had to filed jointly ....OK I agreed so I would get the EIC. Reund quoted ay $3800. On returning a few days later...all changed! Refund $1600, and my 'husband' had to pay IRD 0ver $600.00. I told her what about filing jointly and the $EIC the $3800 refund...she rudely replied I am not arguing with you...I replied Im not arguing I am asking you....then you perceeding to her computer to remove husband name off return (per her)...I said I want to file jointly, I don't want him stuck w///she repeated I am not arguing...I then stood up and asked for my pappers back...she screamed grabbed the papers up "You give me $159.00 and you can have your .....etc.

Then then said get out...I was shocked ,,,she ended by telling me she didnt need my businesses or trash lik eme in her office !!!!

I sent her letter (as mentioned) had a friend of mine call ...as soon as he said On behalf of (my name) she yelled I have attorney and hung up...

So THANKS...Now I know I can charge her with theft!! I am only 24years old, I depended on her advice, and to answer my questions etc...she was rude, unprofessional.
