Capital Gains/Child Support

What is the name of your state? Tennessee
Is it considered capital gains if you sell your primary residence and reinvest in another home? I want to know if it could be considered "income" for child support to be re-evaluated? Last year I was taken back (had not received an increase in wages) and they incorporated all of my fringe benefits (health insurance @ COBRA rates, vacation, life insurance, retirement etc.) I ended up paying 57.00 more per week based on these things because it was termed as "Income". I can't afford to make the same mistake twice.

You should probably post this question in the child support/custody forum.

Depending on how long you owned/lived in your house, you may not have to pay any taxes on the gain. But what the tax code says and what family court says are of course two different things.
