Capital gains taxes

I am from Indiana and my question is, My mother died in december 2005 but she received 58,000 dollars in february 2005 but gave away 30,000 of it. Do we have to pay capital gains taxes on the whole 58,000 or the 30,000 since she didn't keep it? She only made 536 a month in social security and has no assets?

We would need to know where the 58,000 came from, and who she gave the 30,000 to before we could even begin to answer your question.
